1847 manuscript copy of an 1828 law, certified with an attached, partly printed document, “Executive Department

Tuscaloosa, Alabama, 1847. certifying that William Garrett who made this copy of the 1828 act was, in fact, Secretary of State, this certification signed by Joshua S. Martin as Governor and Garrett, as Secretary of State, with the state seal affixed (eroded). The copy presents: “An Act Defining the liability of endorsers and for other purposes … that hereafter the remedy on bills of Exchange, foreign and inland, and on promissory notes payable in Bank, shall be governed by the sales of the Law Merchant, as to days of grace, protect, and notice, and bills drawn and payable within this state shall be deemed inland bills, and those drawn here and payable (truncated) out of state shall be deemed foreign bills, Approved January 15, 1828,” a certification signed by Garrett below. Martin (1799-1856; Governor of Alabama, 1845-1847), a native of Tennessee, moved to Alabama as a young man, read law, and opened a practice in Athens, eventually serving in the legislature and the U.S. Congress (1836-1840) before his election as governor, running on bank issue policies at odds with his fellow Democrats. Garrett (1809-ca. 1880) held the office of Secretary of State, 1840-1852, later serving in both houses of the state legislature. Folded, some edgewear, some old staining and foxing.
